Section 38 of the Sex Discrimination Act remains a sticking point - an existing exemption in the law which permits religious schools to discriminate against staff and students based on their sexuality and gender identity. The Australian Law Reform Commission has recommended its repeal - a proposition many religious leaders do not support.
