The government's controversial migration bill - that could jail asylum seekers who refuse to co-operate with moves to deport them - was rejected by the Senate on the last sitting day before the budget. 

But Shadow Foreign Minister Simon Birmingham says the Coalition won't be to blame if more immigration detainees are released after a High Court case next month, saying there's been "no link drawn by the government" between these laws and the case.
